Lifetime Limited Warranty
This Limited Warranty is issued by Kimakem Refinish USA, LLC(KMK) only to those purchasers whopurchase this coatingand apply it to a vehicle. If this coatingpeels or blisters during theLifetime of the vehicle (as defined below), KMK shall, upon presentation of proof ofpurchase, supply replacement coatings to the purchaserin a quantity that KMK determines is sufficient to repair the peeling or blistering,or refund the original purchaseprice. For the purpose of this Limited Warranty: “Vehicle” shall mean any mechanical device on wheels, designed mainly for use, or used, on highways, except motorized bicycles, vehicles propelled or drawn by horses or human power, or vehicles used exclusively on fixed rails or tracks, or cotton trailers or motorized wheelchairs operated by handicapped persons;and “Lifetime” shall mean one of the following: (i) if you purchase the coating andapply it to a vehicle which you own, Lifetime shall mean the period beginning on the date thatyou purchased the coatingand continuing as long as you own such vehicle; or (ii) if you purchasethe coating and apply it to a vehicle which is owned by someone otherthan you (“Third Party”), Lifetime shall mean the period commencing on the date that you purchasedthe coatingand continuing so long as such Third Party owns such vehicle. This Limited Warrantyshall not apply to anydefect or damage resulting from improper surface preparation, structuraldefects, failure of a previous paint or improper application of the coating, as described in thedirections on the label of thecontainer. This Limited Warranty may not be transferred or assigned.
KMK'S ENTIRE LIABILITY SHALL BE LIMITED EXCLUSIVELY TO PROVIDING REPLACEMENTCOATINGS FOR THE COATING WHICH PEELS OR BLISTERS OR THE REFUNDOF THE ORIGINAL PURCHASE PRICE. THIS WARRANTY EXCLUDES (1) LABOR AND COSTSASSOCIATED WITH LABOR FOR THE APPLICATION OR REMOVAL OF ANY PRODUCT, AND (2) ANYINDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. SOME STATES DO NOT ALLOWTHE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVELIMITATION MAY NOT APPLYTO YOU.
